If you are planning to study in Australia with your spouse or continue your studies while already in Australia, check your visa eligibility before paying a course deposit. New Australia student visa rules took effect on 2 October 2026, changing who can include family members and who can apply from within Australia.

Home Affairs Minister Tony Burke announced the reforms at the National Press Club on 17 September 2026. For Nepali students, the changes make it especially important to review family plans, course choices and application timing before making financial commitments.

Australia continues to welcome international students, who can still apply if they meet the visa requirements. However, family inclusion and onshore applications now require closer attention. This guide explains what to check before deciding your next step.

What Changed in the Australia Student Visa Rules?

The October changes affect Student visa, subclass 500, and certain Student Guardian visa, subclass 590, applications. “Onshore” means applying while physically in Australia. “Offshore” means applying from outside Australia.

Who Can Still Bring Family to Australia?

Under the Australia student visa rules, family eligibility must be checked separately from the student’s own eligibility. Admission to an Australian institution does not automatically allow a partner or dependant children to be included.

Applicants Who May Qualify for a Family Exemption

Applicants may be able to include family members if they are:

  • Studying a PhD.
  • Sponsored by the Department of Foreign Affairs and Trade (DFAT) or Defence.
  • Receiving a foreign government scholarship.
  • Eligible students from a Pacific country or an ASEAN member country.

Nepal is outside the Pacific and ASEAN categories. Nepali applicants therefore need to check whether another family exemption applies. A standard university scholarship should not be treated as a foreign government scholarship.

Students Whose Family Members Are Already Included

If family members are already included in your current Student visa and you are applying in Australia, you may be able to include them in your next Student visa application. The primary applicant and all included family members must be in the same location when the application is lodged.

Having family on your current visa does not, by itself, make you eligible to apply onshore. Your eligibility for another onshore Student visa must be checked separately before making travel plans.

Can Your Spouse Join You Later?

Current Student visa holders can no longer add family members through the subsequent-entrant route after their visa has been granted. There are no exemptions to this restriction. Where family inclusion is permitted, eligible family members must be included at the application stage.

For couples planning to travel on different dates, application timing matters. Do not budget on the assumption that your spouse can obtain a subsequent-entrant Student visa later.

Who Can Apply for a Student Visa Onshore?

Most affected temporary visa holders must be outside Australia when lodging a Student visa application and when the visa is granted. Current primary Student visa holders also face restrictions when applying for another Student visa onshore.

A Student visa dependant who wants to become a primary Student visa applicant must apply offshore and be outside Australia when the visa is granted. There are no exemptions to this particular rule.

Exemptions for Current Primary Student Visa Holders

Current primary Student visa holders may qualify for an onshore application if they:

  • Need up to 12 more months after their original course end date to complete their studies with the same education provider. For a package of courses, the course requiring more time must be the main course.
  • Are sponsored by DFAT or Defence.
  • Are applying to study for a PhD.
  • Are applying for primary or secondary school studies.
  • They have completed their main course with an Australian Qualifications Framework (AQF) level and are progressing to a higher AQF level.
  • Have completed school studies and are progressing to a course without an AQF level.
  • Have completed a course without an AQF level and are progressing to an AQF-level course.
  • Cannot continue their course because their education provider has defaulted.

If you completed a higher education course, your next course under the progression exemption must also be a higher education course delivered by a higher education provider.

Can Student Guardian Visa Holders Apply Again Onshore?

Current Student Guardian visa holders, subclass 590, can continue to lodge a further Student Guardian visa application while in Australia.

What Should You Check Before Accepting Another Offer?

Ask your institution to confirm the qualification level of your completed course and the proposed course. Keep completion records, transcripts and relevant provider correspondence together.

A new offer letter is only one part of planning further study. Before accepting it, check your current visa, the proposed course and where you are eligible to lodge your application under the Australia student visa rules.

For example, progressing from a completed bachelor’s degree to a master’s degree involves a different assessment from taking another qualification at the same level. Course titles alone may not explain those differences.

What Does This Mean for Students Applying from Nepal?

Students applying from Nepal can still pursue study in Australia if they meet the visa requirements. However, family plans need to reflect the new restrictions.

If you intend to study in Australia from Nepal, decide early whether you will apply alone or rely on a family exemption. Check this before choosing accommodation, paying tuition deposits or arranging family travel.

Keep Evidence Level 3 Separate from the October Changes

Evidence requirements and family eligibility address different questions. Strong financial documents do not create an exemption to the family restrictions.

Prepare Your Student Visa Documents Carefully

Check the requirements for your circumstances, including:

  • Confirmation of Enrolment (CoE).
  • Genuine Student responses and supporting evidence.
  • Financial capacity information, where required.
  • Overseas Student Health Cover (OSHC).
  • English language evidence, unless an exemption applies.

Your Genuine Student responses should explain your study plans, academic background and career goals clearly. Support significant claims with relevant documents rather than relying on a generic explanation.

How Much Is the Student Visa Fee in 2026?

The standard primary Student visa application charge starts at AUD 2,500. Concessional rates apply in limited circumstances, including eligible Pacific Island, Timor-Leste and ASEAN applicants, and applicants in the ELICOS and non-award sectors who lodge a valid application.

ELICOS means English Language Intensive Courses for Overseas Students. Nepali students applying in this sector should check whether they qualify for the concession.

The visa charge is separate from tuition, insurance, medical examinations and travel expenses. When budgeting under the Australia student visa rules, check the current charge at lodgement and use an up-to-date exchange rate for your Nepali rupee estimate.

Review the Australia student visa rules before committing to a course or family relocation. A practical preparation sequence is:

  1. Confirm whether your application will be offshore or onshore.
  2. Check the exemption you intend to rely on, if applicable.
  3. Confirm whether family members can be included.
  4. Review your proposed course and gather supporting records.
  5. Check your documents, budget and application timing.

Compare your intended intake with the time needed to prepare your application. Allow time to resolve missing evidence rather than rushing to meet a course start date.

Keep written records of advice about admissions, refunds and deferrals. These can help you make informed decisions if your plans change.
